2. Definitions

  • Terms and Conditions: this document.
  • Consumer: a natural person not acting for commercial or professional purposes.
  • Distance Contract: the agreement between Aurelyon and the Consumer concluded via www.aurelyon.nl.
  • Product(s): all goods or services offered via the webshop.
  • Reflection / Withdrawal Period: the 14-day period during which the Consumer can exercise their right of withdrawal.


3. Applicability and Precedence

  1. These terms apply to every offer from Aurelyon and every distance contract concluded.
  2. Deviations are only valid if agreed upon in writing.
  3. If specific product or service terms conflict with these Terms and Conditions, those specific terms shall prevail.
  4. Prohibited reproduction and resale: Without prior written permission from Aurelyon, it is not allowed to reproduce, duplicate, copy, sell, resell or otherwise exploit any part of the service, software, texts, images, or the use of or access to the service.


4. The Offer & Accuracy of Information

  1. Aurelyon strives for a complete and accurate representation of products. Obvious errors or (color) deviations on screens are not binding.
  2. Color and display disclaimer: Due to screen settings and lighting, the displayed color may differ from the actual product color; no rights can be derived from this.
  3. Historical or archived information may be outdated; Aurelyon is not obliged to update such information.
  4. Right to correction: Aurelyon reserves the right to correct clear errors, inaccuracies or omissions in prices, descriptions or availability, and to cancel or modify orders before shipment.


5. Prices, Payment & Billing Information

  1. All prices are in euros, including VAT and excluding shipping costs unless stated otherwise.
  2. Any applicable shipping or service costs are shown at checkout.
  3. Payment is made in advance using the payment methods offered at checkout. Invoicing is done electronically.
  4. Changes to service and prices: Aurelyon reserves the right to change, suspend or discontinue prices, fees, and/or (parts of) the service or features at any time. Changes do not apply to concluded contracts unless due to changes in VAT or other legal charges.
  5. Current account information: The Consumer is required to provide accurate, current and complete billing and payment details, and to update them promptly so Aurelyon can fulfill the contract properly.


6. Orders: Formation, Limitation & Cancellation

  1. The agreement is formed when the Consumer completes the order process and Aurelyon confirms the order electronically.
  2. Limitation/cancellation: Aurelyon reserves the right to refuse, limit or cancel any order per person, household or order. This includes orders using the same customer account, credit card, billing or shipping address, or in case of suspected resale or fraud. If an order is modified or cancelled, the Consumer will be informed via the provided email or phone number.

7. Delivery & Fulfillment

  1. Orders are shipped within 1–3 business days after payment, unless otherwise stated.
  2. Delivery is only available within the Netherlands to the address provided by the Consumer.
  3. The risk of loss or damage transfers to the Consumer upon physical delivery.
  4. Stated delivery times are indicative and not strict deadlines. In case of delay, the Consumer must first give Aurelyon notice in writing and allow a reasonable period for delivery.


8. Right of Withdrawal (Returns)

  1. The Consumer may cancel the contract within 14 days without stating a reason. A return form must be submitted via the webshop or by email within this period.
  2. After notification, the Consumer has 14 more days to return the product.
  3. In case of full withdrawal, the Consumer will be refunded the full purchase price including standard shipping costs within 14 days after Aurelyon receives the return.
  4. The direct cost of return shipping is the responsibility of the Consumer.
  5. Exclusions: (a) For hygiene reasons, earrings can only be returned if the seal has not been broken and the product remains unused; (b) the right of withdrawal does not apply to custom or personalized jewelry such as engravings or specific ring sizes, in accordance with Article 6:230p(f) of the Dutch Civil Code.

9. Conformity & Warranty

  1. Aurelyon guarantees that products meet the agreement, listed specifications, and reasonable standards of soundness and usability.
  2. Statutory warranty: The Consumer is entitled to free repair or replacement if a product does not conform to the contract (Article 7:17 Dutch Civil Code). These rights remain valid for the legal lifespan of the product.
  3. Commercial warranty: Any additional warranty provided by Aurelyon or the manufacturer does not affect the Consumer’s statutory rights (Article 6:230m(1)(k) Dutch Civil Code).
  4. Defects must be reported by email (with order number) within a reasonable period after discovery.


10. Complaints Procedure

  1. You can send your complaint to info@aurelyon.nl along with your order number. For quicker handling, we recommend using our contact form.
  2. Aurelyon will respond within 3 business days.
  3. If the Consumer is not satisfied with the resolution, they may submit the dispute via the European ODR platform: https://ec.europa.eu/consumers/odr.


11. Optional Tools & Third-Party Links

  1. The webshop may contain tools or links from third parties. Use is at your own risk; Aurelyon accepts no liability for third-party content or performance.
  2. Any additional terms of those third parties apply.


12. User Content (Photos & Reviews)

  1. By submitting images, text, or reviews on the webshop or tagging @Aurelyon_Jewelry or using the hashtag #Aurelyon on social media, the Consumer grants Aurelyon a non-exclusive, worldwide, perpetual, royalty-free license to use, reproduce, publish, edit and display such content for marketing, promotion and documentation purposes.
  2. The Consumer confirms they have all necessary rights and indemnifies Aurelyon from third-party claims.
  3. If submitted or tagged content includes identifiable individuals, Aurelyon will only use it after obtaining explicit consent or anonymizing it, in accordance with the GDPR and portrait rights.


13. Prohibited Use

Use of the site is prohibited for: (a) unlawful purposes; (b) distributing malware; (c) infringing intellectual property; (d) deception; (e) privacy violations; (f) collecting personal data without consent; (g) spamming; (h) reproducing or reselling any part of the service without permission.


14. Personal Data, Cookies, Security & Data Traffic

  1. Aurelyon processes personal data in accordance with the GDPR. See the privacy policy at www.aurelyon.nl/privacy.
  2. Data transmission: Credit card and payment details are always transmitted encrypted via SSL/TLS. Non-credit card data may be transmitted unencrypted and adapted to technical requirements of connecting networks or devices.


15. Liability & Disclaimer

  1. Aurelyon strives to offer secure and error-free service but does not guarantee the webshop will be uninterrupted, timely, secure or error-free.
  2. Our total liability for direct damages is limited to the purchase amount concerned, unless caused by intent or gross negligence.
  3. Aurelyon is never liable for indirect damage such as loss of profit or data.


16. Indemnification

The Consumer indemnifies Aurelyon against third-party claims resulting from use of the webshop or breach of these terms.


17. Force Majeure

Aurelyon is not liable for delays or failure due to circumstances beyond its control (e.g., power outages, platform issues, strikes, natural disasters).


18. Severability

If any provision is found to be invalid, the remaining provisions shall remain in effect. The parties will replace the invalid clause with a valid one that best reflects its purpose.


19. Duration, Termination & Entire Agreement

  1. These terms remain in effect until replaced or terminated.
  2. Aurelyon may terminate access to the service in case of violations.
  3. These terms and all policies published via the webshop form the entire agreement between parties.
  4. Failure by Aurelyon to enforce a right or provision does not constitute a waiver of that right or provision.


20. Changes to the Terms

Aurelyon may update these terms. The most recent version is always available on the website; in case of substantial changes, Consumers will be informed via email or during the order process.


21. Applicable Law & Jurisdiction

These terms are governed exclusively by Dutch law. Disputes will be submitted to the competent court in Amsterdam, unless mandatory law dictates otherwise.
